This Privacy Policy explains how Nishant Chand trading as Atlantis Recruitment Brisbane(ABN 11 229 061 178) ("we", "us", "our") collects, holds, uses and discloses personal information — including through our website, our client portal (used by employers) and our candidate portal (used by job seekers). We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
1. Personal information we collect
Candidates and job seekers:
- name, contact details, location and work rights status;
- resume, employment history, qualifications, skills, licences and tickets;
- salary expectations, availability and notice period;
- screening notes, interview feedback and referee details; and
- any other information you provide to us or that is relevant to a role.
Clients and their representatives:
- business name, ABN/ACN, address and contact details;
- the name, role, email and phone of your authorised representatives;
- talent requests, role requirements and hiring feedback; and
- billing details. Card payments are processed by Stripe — we do not store full card numbers.
Everyone: technical and usage data when you use our website or portals (such as IP address, device and browser information, log-in times and pages viewed).
2. How we collect personal information
We collect information directly from you (including when you register or use our portals, apply for a role, or contact us), from clients about their representatives, from referees with your consent, from job boards, LinkedIn and other recruitment platforms, and from publicly available sources.
3. Why we collect, hold and use it
- to provide recruitment services, assess suitability and match candidates to roles;
- to introduce candidates to prospective employer clients (see section 4);
- to communicate with candidates about employment opportunities;
- to operate, secure and improve our portals, and to manage client subscriptions and billing;
- to comply with our legal obligations; and
- to manage our relationship with you.
4. Disclosure of personal information
To prospective employers through the client portal.We present candidate information (such as a resume, profile summary, availability and salary expectations) to a client only where the candidate is being considered for that client's role. Clients are contractually required to keep candidate information confidential, to use it only for legitimate recruitment purposes, to restrict access to people involved in the hiring decision, to keep it secure, not to build their own candidate database from it, to notify us of any unauthorised access or disclosure, and to securely delete it when no longer required.
To service providers who help us operate the business, such as secure cloud hosting and database services, email delivery, payment processing (Stripe) and professional advisers. These providers may only use personal information to provide their services to us.
Where required by law, including to regulators, courts or law enforcement.
We do not sell personal information.We will not disclose a candidate's information to third-party recruitment firms unless the candidate has first given their express written consent to that disclosure, after being told the purpose of the disclosure, the types of information involved, who may receive it, and whether we may receive a fee.
5. Overseas disclosure
Our portals and database are hosted in Australia (Sydney). Some of our service providers (for example payment and email delivery providers) may process information overseas, including in the United States. Where this occurs we take reasonable steps to ensure the information is handled in accordance with Australian privacy standards.
6. Storage and security
We protect personal information using secure, access-controlled digital systems. Our portals use encryption in transit, per-client data isolation so clients can only see their own information, role-based access, and Australian-based hosting. Access to candidate information within our team is limited to staff who need it for recruitment. Clients are contractually required to keep their portal credentials secure and to protect candidate information in their possession.
7. Retention and deletion
We keep personal information for as long as it is reasonably needed for recruitment purposes and to meet our legal obligations, after which it is securely deleted or de-identified. Candidates may ask us to delete their information at any time (subject to legal requirements). Clients must securely delete candidate information once it is no longer required for the relevant recruitment process.
8. Data breaches
If a data breach occurs that is likely to result in serious harm, we will assess it and notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required under the Notifiable Data Breaches scheme. Clients must notify us within 24 hours if they become aware of compromised portal credentials, unauthorised portal access or any actual or suspected disclosure of candidate information.
9. Access and correction
You may request access to, or correction of, the personal information we hold about you by contacting us using the details below. We will respond within a reasonable time, subject to any legal limitations.
10. Cookies and website analytics
Our website and portals may use cookies and analytics tools to keep you logged in, secure your session and improve the user experience.
11. Complaints
If you have a privacy concern or complaint, please contact us first using the details below and we will investigate and respond. If you are not satisfied with our response, you may complain to the OAIC at oaic.gov.au.
