Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Atlantis Recruitment Brisbane client portal (the "Portal"), operated by Nishant Chand trading as Atlantis Recruitment Brisbane (ABN 11 229 061 178) ("we", "us", "our"). By creating an account and ticking the acceptance box, you agree to these Terms on behalf of the business you register.
1. Eligibility and authority
The Portal is for business use. By signing up you confirm you are authorised to enter into agreements on behalf of the business you register, and that each person you give access to is an authorised representative of that business who is genuinely involved in its recruitment.
2. The service
We provide monthly recruitment support services under the subscription package you select. The detailed scope, candidate ranges and service terms are set out in the Client Subscription Agreement Form and our Standard Terms and Conditions, which you review and sign in the Portal. Those documents govern the recruitment relationship; these Terms govern your use of the Portal itself. If there is any inconsistency about the services, the signed documents prevail.
3. Your account and authorised users
- You must provide accurate information when registering and keep it up to date.
- Portal access is restricted to authorised representatives of your business. Login credentials must be kept secure and confidential and must not be shared. Each user must log in with their own credentials.
- You are responsible for all activity that occurs under your business's accounts.
- You must remove a user's access (via the Team section) or tell us promptly when they no longer need it — for example, when they leave your business.
4. Fees, GST and billing
- Subscription fees are charged to the payment card you save in the Portal, automatically in advance each month, through our secure payment provider (Stripe).
- Prices shown are exclusive of GST; GST is added where applicable.
- Each package has a 6-month minimum commitment, as set out in your signed agreement.
- If a payment is declined or fails, your access to the Portal may be locked and services paused until the outstanding amount is paid, as described in the Standard Terms and Conditions. This does not release you from the 6-month minimum commitment.
5. Cancellation
Cancellation and the treatment of the 6-month minimum commitment are governed by your signed Client Subscription Agreement and Standard Terms and Conditions. You can manage your subscription from the Billing section.
6. Acceptable use of the Portal
You must not, and must ensure your users do not:
- scrape, harvest, crawl, bulk download or otherwise systematically extract candidate information or any other content from the Portal;
- use candidate information or Portal content to build, populate or supplement your own candidate database or talent pool, or any database for a third party;
- use candidate information for any purpose other than legitimate recruitment purposes associated with the services we provide to you;
- attempt to access other clients' accounts or data, or our systems, without authorisation;
- copy, modify, reverse engineer or create derivative works from the Portal;
- introduce any virus, malicious code or automated tool, or interfere with the Portal's operation or security; or
- allow any third party to access or use the Portal.
7. Candidate information
All candidate details, resumes, profiles, summaries, notes and contact details made available through the Portal are confidential. You must not share, forward, refer or disclose them to any third party without our written consent. You must also:
- use candidate information only for legitimate recruitment purposes connected to our services;
- restrict access to personnel who are genuinely involved in the relevant recruitment process;
- keep candidate information secure against unauthorised access, use, disclosure or loss;
- not retain candidate information to develop your own candidate database;
- notify us immediately of any actual or suspected unauthorised access, use or disclosure of candidate information; and
- securely delete or destroy candidate information (including copies) when it is no longer reasonably required for the recruitment process, or earlier if we ask.
8. Data security and incident notification
You must take reasonable steps to protect your Portal credentials and any candidate information in your possession. You must notify us immediately (and within 24 hours) if you become aware of compromised, lost or stolen credentials, any unauthorised access to the Portal or your accounts, or any actual or suspected disclosure of candidate information — and cooperate with us to investigate and contain the incident, including for any notification required under the Privacy Act 1988 (Cth).
9. Suspension of access
We may immediately suspend or restrictyour (or any user's) access to the Portal, without prior notice, where we reasonably suspect unauthorised access, misuse of candidate information, a security incident, a breach of these Terms or any other serious breach. We may also temporarily suspend access while we investigate an actual or suspected security or privacy incident, and will restore it once we are reasonably satisfied the matter is resolved. Suspension does not release you from the 6-month minimum commitment or any amounts payable.
10. Intellectual property
We (or our licensors) own the Portal, its software, database structure, candidate database, recruitment methodologies, templates, candidate summaries, reports, market-mapping information, branding and all other proprietary materials. You receive only a limited, non-exclusive, non-transferable, revocable right to access and use them for the purpose of receiving our services. Nothing in these Terms transfers any ownership to you.
11. Electronic signatures and communications
You agree that signing documents electronically in the Portal, and receiving communications electronically, are valid and binding.
12. Disclaimers and liability
We provide the services with reasonable care and skill but do not guarantee a successful hire, and candidate ranges are indicative targets rather than guaranteed minimums. To the extent permitted by law, our liability is limited as set out in the Standard Terms and Conditions. Nothing in these Terms excludes rights or guarantees that cannot be excluded under the Australian Consumer Law.
13. Privacy
Each of us must comply with all privacy and data protection laws that apply to us, including the Privacy Act 1988 (Cth) where applicable. We handle personal information in accordance with our Privacy Policy.
14. Governing law
These Terms are governed by the laws of Queensland, Australia.
15. Changes
We may update these Terms from time to time. The latest version will always be available here.
